These terms govern your use of the Shimelesabera Foundation website, your donations, and your applications.

1. Introduction

Welcome to the Shimelesabera Foundation website (the “Website”). The Shimelesabera Foundation (referred to as “we,” “our,” “us,” or the “Foundation”) is a non-profit organization registered in Ethiopia.

These Terms & Conditions (“Terms”) govern your access to and use of the Website, including any content, functionality, and services offered on or through the Website (collectively, the “Services”), as well as any donations you make or applications you submit through the Website.

Please read these Terms carefully before using the Website or making a donation. By accessing or using the Website, making a donation, or submitting an application, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Website, make a donation, or submit an application.

2. Definitions

  • “Donor” means any individual or entity that makes a donation through the Website.
  • “Applicant” means any individual or entity that submits an application for services, funding, partnership, or employment through the Website.
  • “Beneficiary” means any individual who receives services from the Foundation.
  • “Content” means all text, graphics, images, videos, audio, data, and other materials available on the Website.
  • “User” means any person who accesses or uses the Website.

3.1 Eligibility

By using the Website, you represent and warrant that:

  • You are at least 18 years of age (or the age of majority in your jurisdiction).
  • You have the legal capacity to enter into these Terms.
  • You will use the Website in compliance with all applicable laws and regulations, including the laws of the Federal Democratic Republic of Ethiopia.

4. Donations

4.1 General

The Foundation accepts donations through the Website to support its mission of providing free education, healthcare, and elder care to vulnerable populations in Ethiopia.

4.2 Donation Processing

All donations are processed through secure third-party payment processors. By making a donation, you agree to provide accurate and complete payment information. You represent and warrant that you are authorized to use the payment method you provide.

4.3 Donation Purpose

Unless otherwise specified by you at the time of donation, all donations will be used at the Foundation’s discretion to further its charitable mission. If you designate your donation for a specific purpose (for example, a particular pillar or programme), we will make reasonable efforts to apply your donation accordingly. However, we reserve the right to reallocate funds if the designated purpose becomes impractical or impossible.

4.4 Tax Deductibility

Donations may be tax-deductible to the extent permitted by applicable law. It is your responsibility to consult with your tax advisor regarding the deductibility of your donation. We will provide you with a receipt or acknowledgment letter upon request.

4.5 Recurring Donations

If you set up a recurring donation, you authorize us to charge your designated payment method on the schedule you select. You may cancel your recurring donation at any time by contacting us at [email protected]. Cancellations will take effect after the next scheduled payment has been processed.

4.6 Refund Policy

All donations are generally non-refundable. However, if an error occurs in processing your donation, please contact us at [email protected] within 30 days of the transaction, and we will investigate and, if appropriate, issue a refund.

4.7 Donor Privacy

We are committed to protecting your privacy. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal information.

5. Applications

5.1 Types of Applications

The Website may allow you to submit applications for:

  • Beneficiary services — applying for assistance from the Foundation (for example, school enrollment, medical care, senior centre placement).
  • Funding and partnerships — applying for grants or partnership opportunities.
  • Employment and volunteering — applying for job openings or volunteer positions.

5.2 Accuracy of Information

By submitting an application, you represent and warrant that all information you provide is true, accurate, complete, and not misleading. You agree to notify us promptly of any changes to the information you have provided.

5.3 Application Processing

We will review all applications in accordance with our internal policies and procedures. Submission of an application does not guarantee approval, acceptance, or any form of benefit. We reserve the right to accept, reject, or request additional information for any application at our sole discretion.

5.5 Beneficiary Eligibility

For applications for beneficiary services, you acknowledge that:

  • Services are provided free of charge only to eligible individuals as determined by our criteria.
  • We reserve the right to verify all information provided and to conduct home visits or other assessments.
  • We may prioritize applications based on need and available resources.
  • We may terminate or modify services at any time due to funding constraints or other operational considerations.

6. Intellectual Property

6.1 Ownership

All Content on the Website, including but not limited to text, graphics, logos, images, videos, and software, is the property of the Shimelesabera Foundation or its licensors and is protected by Ethiopian and international copyright, trademark, and other intellectual property laws.

6.2 Limited License

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website and its Content for personal, non-commercial purposes. You may not:

  • Reproduce, distribute, modify, or create derivative works of any Content without our prior written consent.
  • Use our name, logo, or trademarks without our prior written consent.
  • Remove any copyright or proprietary notices from any Content.

6.3 User-Generated Content

TO THE FULLEST EXTENT PERMITTED BY LAW, THE FOUNDATION DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that:

  • The Website will be uninterrupted, error-free, or secure.
  • Any errors or defects will be corrected.
  • The Website or its servers are free of viruses or other harmful components.
  • Any information obtained through the Website is accurate, reliable, or complete.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE FOUNDATION, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE WEBSITE, YOUR DONATION, OR YOUR APPLICATION, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.

In no event shall our total liability to you for all claims arising out of or relating to these Terms or your use of the Website exceed the amount of your donation, if any, or 1,000 Ethiopian Birr (ETB), whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Foundation and its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of the Website in violation of these Terms.
  • Any content you submit to the Website.
  • Your violation of any applicable law or regulation.
  • Your violation of any third-party rights.

11. Privacy

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms and any dispute arising out of or relating to these Terms, your use of the Website, your donation, or your application shall be governed by and construed in accordance with the laws of the Federal Democratic Republic of Ethiopia, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms shall first be referred to the Foundation’s Executive Director for amicable resolution within 30 days of written notice. If the dispute is not resolved amicably, it shall be finally settled by arbitration in accordance with the rules of the Addis Ababa Chamber of Commerce and Sectoral Associations (or equivalent). The arbitration shall be conducted in Addis Ababa, in the English language, and the award shall be final and binding. The prevailing party shall be entitled to recover its reasonable legal fees and costs.

12.3 Waiver of Class Actions

To the fullest extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13. Modifications to These Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Website. Your continued use of the Website after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Termination

We may terminate or suspend your access to the Website, in whole or in part, at any time without notice if we believe you have violated these Terms or applicable law. Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property, disclaimer of warranties, limitation of liability, and governing law.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be replaced with a valid provision that most closely achieves the original intent.

16. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Website, constitute the entire agreement between you and the Foundation regarding your use of the Website, your donation, and your application, and supersede all prior agreements and understandings.

ውል ውሎች እና መመሪያዎች

እነዚህ ውሎች የሽመልስ አበራ ፋውንዴሽንን ድህረ ገጽ አጠቃቀም፣ ልገሳዎችዎን እና ማመልከቻዎችዎን ይመራሉ።

1. መግቢያ

ወደ ሽመልስ አበራ ፋውንዴሽን ድህረ ገጽ (“ድህረ ገጽ”) እንኳን በደህና መጡ። ሽመልስ አበራ ፋውንዴሽን (ከአሁን በኋላ “እኛ”፣ “የእኛ”፣ “እኛን” ወይም “ፋውንዴሽኑ” ተብሎ የሚጠራ) በኢትዮጵያ የተመዘገበ ለትርፍ ያልተቋቋመ ድርጅት ነው።

እነዚህ ውል ውሎች እና መመሪያዎች (“ውሎች”) ድህረ ገጹን፣ በድህረ ገጹ ላይ የሚቀርቡ ይዘቶችን፣ ተግባራትን እና አገልግሎቶችን (በአጠቃላይ “አገልግሎቶች” ተብለው የሚጠሩ) እንዲሁም በድህረ ገጹ በኩል የሚደረጉ ልገሳዎችን እና ማመልከቻዎችን መጠቀምን ይመራሉ።

እባክዎ ድህረ ገጹን ከመጠቀምዎ ወይም ልገሳ ከማድረግዎ በፊት እነዚህን ውሎች በጥንቃቄ ያንብቡ። ድህረ ገጹን በመጠቀም፣ ልገሳ በማድረግ፣ ወይም ማመልከቻ በማስገባት እነዚህን ውሎች እና የግላዊነት ፖሊሲያችንን ተቀብለዋል ማለት ነው። እነዚህን ውሎች የማይቀበሉ ከሆነ ድህረ ገጹን መጠቀም፣ ልገሳ ማድረግ፣ ወይም ማመልከቻ ማስገባት የለብዎትም።

2. ፍቺዎች

  • “ለጋሽ” ማለት በድህረ ገጹ በኩል ልገሳ የሚያደርግ ማንኛውም ግለሰብ ወይም ተቋም ማለት ነው።
  • “አመልካች” ማለት በድህረ ገጹ በኩል ለአገልግሎት፣ ለገንዘብ ድጋፍ፣ ለሽርክና፣ ወይም ለሥራ ማመልከቻ የሚያስገባ ማንኛውም ግለሰብ ወይም ተቋም ማለት ነው።
  • “ተጠቃሚ (Beneficiary)” ማለት ከፋውንዴሽኑ አገልግሎት የሚቀበል ማንኛውም ግለሰብ ማለት ነው።
  • “ይዘት” ማለት በድህረ ገጹ ላይ የሚገኙ ጽሑፎች፣ ሥዕሎች፣ ምስሎች፣ ቪዲዮዎች፣ ድምፆች፣ መረጃዎች እና ሌሎች ቁሳቁሶች ሁሉ ማለት ነው።
  • “ተጠቃሚ (User)” ማለት ድህረ ገጹን የሚጠቀም ማንኛውም ሰው ማለት ነው።

3. የድህረ ገጽ አጠቃቀም

3.1 ብቃት

ድህረ ገጹን በመጠቀም የሚከተሉትን እውነት መሆናቸውን ያረጋግጣሉ፦

  • ቢያንስ 18 ዓመት ሞልተዋል (ወይም በሚኖሩበት ስፍራ ያለው የአቅመ አዳም/ሔዋን ዕድሜ ደርሰዋል)።
  • እነዚህን ውሎች ለመግባት ህጋዊ አቅም አለዎት።
  • ድህረ ገጹን የሚጠቀሙት የኢትዮጵያ ፌዴራላዊ ዲሞክራሲያዊ ሪፐብሊክ ህጎችን ጨምሮ ከሚመለከታቸው ህጎች እና ደንቦች ጋር በማክበር ነው።

3.2 የተፈቀደ አጠቃቀም

ድህረ ገጹን ህጋዊ በሆኑ ዓላማዎች እና ከእነዚህ ውሎች ጋር በሚስማማ መልኩ ብቻ መጠቀም ይችላሉ። የሚከተሉትን ላለማድረግ ተስማምተዋል፦

  • ድህረ ገጹን ማንኛውንም ህግ ወይም ደንብ በሚጥስ መንገድ መጠቀም።
  • ያለፈቃድ ወደ ድህረ ገጹ ክፍሎች፣ አገልጋዮች፣ ወይም የውሂብ ጎታዎች ለመግባት መሞከር።
  • ድህረ ገጹን ቫይረሶችን፣ ማልዌርን፣ ወይም ሌላ ጎጂ ኮድ ለማስተላለፍ መጠቀም።
  • የድህረ ገጹን አሠራር ማደናቀፍ ወይም ማወክ።
  • ያለቅድመ-ጽሑፍ ፈቃዳችን ድህረ ገጹን ለማንኛውም የንግድ ዓላማ መጠቀም።
  • ማንኛውንም ሰው ወይም ተቋም መምሰል ወይም ከማንኛውም ሰው ወይም ተቋም ጋር ያለዎትን ግንኙነት በተሳሳተ መንገድ መግለጽ።

3.3 የተጠቃሚ መለያ

የድህረ ገጹ አንዳንድ ክፍሎች እንዲመዘገቡ እና መለያ እንዲፈጥሩ ሊጠይቁ ይችላሉ። የመለያዎን ሚስጥራዊነት የመጠበቅ እና በመለያዎ ስር የሚከናወኑ ሁሉንም ተግባራት የመቆጣጠር ኃላፊነት አለብዎት። መለያዎ ያለፈቃድ ጥቅም ላይ የዋለ ከሆነ ወዲያውኑ እንዲያሳውቁን ተስማምተዋል።

4. ልገሳዎች

4.1 አጠቃላይ

ፋውንዴሽኑ በኢትዮጵያ ለተጎጂዎች ነፃ ትምህርት፣ የጤና እንክብካቤ እና የአረጋውያን እንክብካቤ ለመስጠት ያለውን ተልእኮ ለመደገፍ በድህረ ገጹ በኩል ልገሳዎችን ይቀበላል።

4.2 የልገሳ ሂደት

ሁሉም ልገሳዎች ደህንነታቸው በተጠበቀ የሶስተኛ ወገን የክፍያ አስተናጋጆች በኩል ይስተናገዳሉ። ልገሳ በማድረግ ትክክለኛ እና ሙሉ የክፍያ መረጃ ለመስጠት ተስማምተዋል። የሚጠቀሙበትን የክፍያ ዘዴ ለመጠቀም የተፈቀደልዎት መሆኑን ያረጋግጣሉ።

4.3 የልገሳ ዓላማ

በልገሳ ጊዜ በእርስዎ ካልተገለጸ በስተቀር፣ ሁሉም ልገሳዎች የበጎ አድራጎት ተልእኮውን ለማራመድ በፋውንዴሽኑ ውሳኔ ጥቅም ላይ ይውላሉ። ልገሳዎን ለተወሰነ ዓላማ ከገለጹ (ለምሳሌ፣ ለተወሰነ ምሰሶ ወይም ፕሮግራም) ልገሳዎን በተገቢው መንገድ ለመተግበር ምክንያታዊ ጥረት እናደርጋለን። ነገር ግን፣ የተገለጸው ዓላማ ተግባራዊ ሊሆን የማይችል ወይም የማይቻል ከሆነ ገንዘቦችን ዳግም የመመደብ መብታችንን ይዘን እንቆያለን።

4.4 የታክስ ቅነሳ

ልገሳዎች በሚመለከተው ህግ በሚፈቀደው መጠን ከታክስ ቅናሽ ሊበቁ ይችላሉ። የልገሳዎን ቅነሳ በተመለከተ የታክስ አማካሪዎን ማማከር የእርስዎ ኃላፊነት ነው። በጥያቄ ጊዜ ደረሰኝ ወይም የእውቅና ደብዳቤ እንሰጥዎታለን።

4.5 ተደጋጋሚ ልገሳዎች

ተደጋጋሚ ልገሳ ካዘጋጁ፣ የመረጡትን የክፍያ ዘዴ በሚመርጡት መርሃ ግብር መሰረት እንድንከፍል ፈቃድ ሰጥተዋል። ተደጋጋሚ ልገሳዎን በማንኛውም ጊዜ በ [email protected] በኩል በማግኘት መሰረዝ ይችላሉ። መሰረዙ የሚሠራው የሚቀጥለው የታቀደ ክፍያ ከተከናወነ በኋላ ነው።

4.6 የመመለስ ፖሊሲ

ሁሉም ልገሳዎች በአጠቃላይ የማይመለሱ ናቸው። ነገር ግን፣ ልገሳዎን በማስኬድ ጊዜ ስህተት ከተፈጠረ፣ እባክዎ ከግብይቱ በኋላ ባሉት 30 ቀናት ውስጥ በ [email protected] ያግኙን፤ እኛም እንመረምራለን፣ አግባብ ከሆነም ገንዘቡን እንመልሳለን።

4.7 የለጋሽ ግላዊነት

የእርስዎን ግላዊነት ለመጠበቅ ቁርጠኞች ነን። የግል መረጃዎን እንዴት እንደምንሰበስብ፣ እንደምንጠቀም እና እንደምንጠብቅ ለማወቅ እባክዎ የግላዊነት ፖሊሲያችንን ይመልከቱ።

5. ማመልከቻዎች

5.1 የማመልከቻ ዓይነቶች

ድህረ ገጹ ለሚከተሉት ማመልከቻዎች እንዲያስገቡ ሊያስችልዎት ይችላል፦

  • የተጠቃሚ አገልግሎቶች — ከፋውንዴሽኑ እርዳታ ለማግኘት (ለምሳሌ፣ የትምህርት ቤት ምዝገባ፣ የህክምና እንክብካቤ፣ የአረጋውያን ማዕከል ቦታ)።
  • የገንዘብ ድጋፍ እና ሽርክና — ለእርዳታ ወይም ለሽርክና ዕድሎች ማመልከት።
  • ሥራ እና በጎ ፈቃደኝነት — ለሥራ ክፍት ቦታዎች ወይም ለበጎ ፈቃደኞች ቦታዎች ማመልከት።

5.2 የመረጃ ትክክለኛነት

ማመልከቻ በማስገባት፣ የሚሰጡት መረጃ ሁሉ እውነት፣ ትክክለኛ፣ ሙሉ እና አሳሳች ያልሆነ መሆኑን ያረጋግጣሉ። በሰጡት መረጃ ላይ ማንኛውም ለውጥ ካለ ወዲያውኑ እንዲያሳውቁን ተስማምተዋል።

5.3 የማመልከቻ ሂደት

ሁሉንም ማመልከቻዎች በውስጥ ፖሊሲዎቻችን እና ሂደቶቻችን መሰረት እንገመግማለን። ማመልከቻ ማስገባት ብቻውን መጽደቅን፣ መቀበልን ወይም ማንኛውንም ዓይነት ጥቅም ማግኘትን አያረጋግጥም። ማንኛውንም ማመልከቻ በራሳችን ውሳኔ የመቀበል፣ ውድቅ የማድረግ፣ ወይም ተጨማሪ መረጃ የመጠየቅ መብታችንን ይዘን እንቆያለን።

5.4 ሚስጥራዊነት

ሁሉም የማመልከቻ መረጃዎች እንደ ሚስጥር ይቆጠራሉ፣ እናም ማመልከቻዎን ለመገምገም እና ፕሮግራሞቻችንን ለማስተዳደር ብቻ ጥቅም ላይ ይውላሉ። ለበለጠ መረጃ እባክዎ የግላዊነት ፖሊሲያችንን ይመልከቱ።

5.5 የተጠቃሚ ብቃት

ለተጠቃሚ አገልግሎቶች በሚቀርቡ ማመልከቻዎች ላይ የሚከተሉትን ያረጋግጣሉ፦

  • አገልግሎቶች የሚሰጡት በመመዘኛዎቻችን መሰረት ብቁ ለሆኑ ግለሰቦች ብቻ በነፃ ነው።
  • የተሰጠውን ሁሉንም መረጃ የማረጋገጥ እና የቤት ጉብኝት ወይም ሌላ ግምገማ የማድረግ መብታችንን ይዘን እንቆያለን።
  • በፍላጎት እና በሚገኙ ሀብቶች ላይ በመመስረት ማመልከቻዎችን ቅድሚያ ልንሰጥ እንችላለን።
  • በገንዘብ እጥረት ወይም በሌሎች የሥራ ሁኔታዎች ምክንያት አገልግሎቶችን በማንኛውም ጊዜ የማቋረጥ ወይም የመቀየር መብታችንን ይዘን እንቆያለን።

6. የአእምሮአዊ ንብረት መብቶች

6.1 ባለቤትነት

በድህረ ገጹ ላይ ያለው ሁሉም ይዘት፣ ጽሑፎችን፣ ሥዕሎችን፣ አርማዎችን፣ ምስሎችን፣ ቪዲዮዎችን እና ሶፍትዌሮችን ጨምሮ፣ የሽመልስ አበራ ፋውንዴሽን ወይም የፈቃድ ሰጪዎቹ ንብረት ነው፤ በኢትዮጵያ እና በዓለም አቀፍ የቅጂ መብት፣ የንግድ ምልክት እና ሌሎች የአእምሮአዊ ንብረት ህጎችም ይጠበቃል።

6.2 የተገደበ ፈቃድ

ድህረ ገጹን እና ይዘቶቹን ለግል፣ ለንግድ ላልሆኑ ዓላማዎች ለመጠቀም የተገደበ፣ ልዩ ያልሆነ፣ የማይተላለፍ እና ሊሰረዝ የሚችል ፈቃድ ተሰጥቶዎታል። የሚከተሉትን ማድረግ አይችሉም፦

  • ያለቅድመ-ጽሑፍ ፈቃዳችን ማንኛውንም ይዘት ማባዛት፣ ማሰራጨት፣ መቀየር፣ ወይም ተዋጽኦ ሥራ መፍጠር።
  • ያለቅድመ-ጽሑፍ ፈቃዳችን ስማችንን፣ አርማችንን፣ ወይም የንግድ ምልክቶቻችንን መጠቀም።
  • ከማንኛውም ይዘት ላይ የቅጂ መብት ወይም የባለቤትነት ማስታወቂያዎችን ማስወገድ።

6.3 በተጠቃሚ የተፈጠረ ይዘት

ለድህረ ገጹ ማንኛውንም ይዘት (ለምሳሌ፣ አስተያየቶች፣ ምስክርነቶች፣ ግብረ መልስ) ካስገቡ፣ እንደዚህ ያለውን ይዘት ከተልእኮአችን ጋር በተያያዘ ለማንኛውም ዓላማ ለመጠቀም፣ ለማባዛት፣ ለማስተካከል፣ ለማላመድ፣ ለማተም እና ለማሰራጨት ልዩ ያልሆነ፣ ክፍያ-ነጻ፣ ዘላቂ፣ የማይሻር እና ዓለም አቀፍ ፈቃድ ይሰጡናል።

7. ወደ ሶስተኛ ወገን ድህረ ገጾች የሚወስዱ አገናኞች

ድህረ ገጹ በፋውንዴሽኑ ያልተያዙ ወይም ያልተቆጣጠሩ የሶስተኛ ወገን ድህረ ገጾች ወይም አገልግሎቶች አገናኞችን ሊይዝ ይችላል። በማንኛውም የሶስተኛ ወገን ድህረ ገጽ ይዘት፣ የግላዊነት ፖሊሲ፣ ወይም አሠራር ላይ ቁጥጥር የለንም፣ ኃላፊነትም አንወስድም። እንደዚህ ያሉ ድህረ ገጾችን የሚጎበኙት በራስዎ ኃላፊነት ነው፤ የሚጎበኙትን ማንኛውንም የሶስተኛ ወገን ድህረ ገጽ ውሎችና የግላዊነት ፖሊሲዎች እንዲገመግሙ እናበረታታለን።

8. የዋስትና አለመኖር

ድህረ ገጹ እና ሁሉም ይዘቶች፣ አገልግሎቶች እና የልገሳ ሂደቶች ያለ ምንም ዓይነት ግልጽ ወይም ስውር ዋስትና “ባለበት ሁኔታ” እና “በሚገኝበት ሁኔታ” ይቀርባሉ። በህግ በሚፈቀደው ከፍተኛ መጠን፣ ፋውንዴሽኑ የንግድ ብቃት፣ ለተወሰነ ዓላማ ተስማሚነት፣ መጣስ አለመኖር እና ትክክለኛነት የሚሉትን ስውር ዋስትናዎች ጨምሮ ሁሉንም ዋስትናዎች ይክዳል።

የሚከተሉትን አናረጋግጥም፦

  • ድህረ ገጹ ያልተቋረጠ፣ ስህተት-አልባ፣ ወይም ደህንነቱ የተጠበቀ እንደሚሆን።
  • ማንኛቸውም ስህተቶች ወይም ጉድለቶች እንደሚስተካከሉ።
  • ድህረ ገጹ ወይም አገልጋዮቹ ከቫይረሶች ወይም ከሌሎች ጎጂ አካላት ነጻ እንደሆኑ።
  • በድህረ ገጹ በኩል የሚገኝ ማንኛውም መረጃ ትክክለኛ፣ አስተማማኝ፣ ወይም ሙሉ እንደሆነ።

9. የኃላፊነት ገደብ

በሚመለከተው ህግ በሚፈቀደው ከፍተኛ መጠን፣ ፋውንዴሽኑ፣ ዳይሬክተሮቹ፣ ኃላፊዎቹ፣ ሠራተኞቹ፣ ወኪሎቹ እና ተባባሪዎቹ ድህረ ገጹን በመጠቀምዎ፣ በልገሳዎ፣ ወይም በማመልከቻዎ ምክንያት ለሚነሱ ቀጥተኛ ያልሆኑ፣ ድንገተኛ፣ ልዩ፣ ተከታታይ፣ ወይም የቅጣት ጉዳቶች ሁሉ — የትርፍ መጥፋትን፣ የውሂብ መጥፋትን፣ ወይም የመልካም ስም መጥፋትን ጨምሮ — ተጠያቂ አይሆኑም።

ከእነዚህ ውሎች ወይም ድህረ ገጹን ከመጠቀምዎ ጋር በተያያዘ ለሚነሱ ሁሉም የይገባኛል ጥያቄዎች ጠቅላላ ኃላፊነታችን ከልገሳዎ መጠን (ካለ) ወይም ከ1,000 የኢትዮጵያ ብር፣ ከሁለቱ የሚበልጠውን አይበልጥም።

10. ማካካሻ

ፋውንዴሽኑን እና ዳይሬክተሮቹን፣ ኃላፊዎቹን፣ ሠራተኞቹን፣ ወኪሎቹን እና ተባባሪዎቹን ከሚከተሉት ምክንያቶች በሚነሱ ማንኛቸውም የይገባኛል ጥያቄዎች፣ ኃላፊነቶች፣ ጉዳቶች፣ ኪሳራዎች፣ ወጪዎች እና ክፍያዎች (ምክንያታዊ የህግ ክፍያዎችን ጨምሮ) ለማካካስ፣ ለመከላከል እና ነጻ ለማድረግ ተስማምተዋል፦

  • ድህረ ገጹን ከእነዚህ ውሎች ጋር በሚጣረስ መንገድ መጠቀምዎ።
  • ለድህረ ገጹ ያስገቡት ማንኛውም ይዘት።
  • ማንኛውንም ተፈጻሚ ህግ ወይም ደንብ መጣስዎ።
  • ማንኛውንም የሶስተኛ ወገን መብት መጣስዎ።

11. ግላዊነት

ድህረ ገጹን መጠቀምዎ በግላዊነት ፖሊሲያችን ጭምር ይመራል፤ ይህም በእነዚህ ውሎች ውስጥ በማጣቀሻ ተካቷል። የግል መረጃዎን በተመለከተ ያለንን የአሰባሰብ፣ የአጠቃቀም እና የጥበቃ አሠራር ለመረዳት እባክዎ የግላዊነት ፖሊሲያችንን ይገምግሙ።

12. የመመሪያ ህግ እና የክርክር አፈታት

12.1 የመመሪያ ህግ

እነዚህ ውሎች እና ከእነዚህ ውሎች፣ ድህረ ገጹን ከመጠቀምዎ፣ ከልገሳዎ፣ ወይም ከማመልከቻዎ ጋር በተያያዘ የሚነሱ ማንኛቸውም ክርክሮች የኢትዮጵያ ፌዴራላዊ ዲሞክራሲያዊ ሪፐብሊክ ህጎችን መሰረት አድርገው ይተዳደራሉ፤ ይተረጎማሉም።

12.2 የክርክር አፈታት

ከእነዚህ ውሎች ጋር በተያያዘ የሚነሳ ማንኛውም ክርክር፣ አለመግባባት፣ ወይም የይገባኛል ጥያቄ በመጀመሪያ ከጽሑፍ ማስታወቂያ በኋላ ባሉት 30 ቀናት ውስጥ ለወዳጃዊ አፈታት ለፋውንዴሽኑ ዋና ሥራ አስፈጻሚ መቅረብ አለበት። ክርክሩ በወዳጃዊ መንገድ ካልተፈታ፣ በአዲስ አበባ ንግድ ምክር ቤት እና የዘርፍ ማህበራት (ወይም ተመጣጣኝ አካል) ደንቦች መሰረት በግልግል ዳኝነት በመጨረሻ ይፈታል። ግልግሉ በአዲስ አበባ፣ በእንግሊዝኛ ቋንቋ ይካሄዳል፤ ውሳኔውም የመጨረሻ እና አስገዳጅ ይሆናል። ያሸነፈው ወገን ምክንያታዊ የህግ ክፍያዎችንና ወጪዎችን የማግኘት መብት አለው።

12.3 የመደብ ክስ መተው

በህግ በሚፈቀደው ከፍተኛ መጠን፣ ማንኛውም የክርክር አፈታት ሂደት የሚካሄደው በግለሰብ ደረጃ ብቻ እንጂ እንደ መደብ፣ እንደተዋሃደ፣ ወይም እንደ ተወካይ ክስ እንዳልሆነ ተስማምተዋል።

13. የእነዚህ ውሎች ማሻሻያ

እነዚህን ውሎች በማንኛውም ጊዜ የመቀየር መብታችንን ይዘን እንቆያለን። ማንኛውም ለውጥ በድህረ ገጹ ላይ ከተለጠፈ በኋላ ወዲያውኑ ተፈጻሚ ይሆናል። ከለውጡ በኋላ ድህረ ገጹን መጠቀምዎን መቀጠል የተሻሻሉትን ውሎች ተቀብለዋል ማለት ነው። እነዚህን ውሎች በየጊዜው እንዲገመግሙ እናበረታታለን።

14. ማቋረጥ

እነዚህን ውሎች ወይም ተፈጻሚ ህግ ጥሰዋል ብለን የምናምን ከሆነ በማንኛውም ጊዜ ያለማስታወቂያ ወደ ድህረ ገጹ ያለዎትን መዳረሻ ሙሉ በሙሉ ወይም በከፊል ማቋረጥ ወይም ማገድ እንችላለን። ሲቋረጥ፣ በተፈጥሯቸው ከማቋረጥ በኋላ መቆየት ያለባቸው ሁሉም የእነዚህ ውሎች አንቀጾች — የአእምሮአዊ ንብረት፣ የዋስትና አለመኖር፣ የኃላፊነት ገደብ እና የመመሪያ ህግን ጨምሮ — ተፈጻሚ ሆነው ይቀጥላሉ።

15. መለያየት

የእነዚህ ውሎች ማንኛውም አንቀጽ ልክ ያልሆነ፣ ህገወጥ፣ ወይም ተግባራዊ ሊሆን የማይችል ሆኖ ከተገኘ፣ የተቀሩት አንቀጾች ሙሉ በሙሉ ሥራ ላይ ይቆያሉ፤ ልክ ያልሆነውም አንቀጽ የመጀመሪያውን ዓላማ በቅርበት በሚያሳካ ትክክለኛ አንቀጽ ይተካል።

16. መተው

የእነዚህ ውሎች ማንኛውም ውል መተው የዚያ ውል ወይም የሌላ ማንኛውም ውል ቀጣይ መተው ተደርጎ አይወሰድም። ማንኛውንም የእነዚህ ውሎች መብት ወይም ድንጋጌ ማስፈጸም አለመቻላችን የዚያን መብት ወይም ድንጋጌ መተው አይሆንም።

17. ሙሉ ስምምነት

እነዚህ ውሎች፣ ከግላዊነት ፖሊሲያችን እና በድህረ ገጹ ላይ ከታተሙ ሌሎች ህጋዊ ማስታወቂያዎች ጋር በመሆን፣ ድህረ ገጹን በመጠቀምዎ፣ በልገሳዎ እና በማመልከቻዎ ላይ በእርስዎ እና በፋውንዴሽኑ መካከል ያለውን ሙሉ ስምምነት ይወክላሉ፤ ሁሉንም ቀዳሚ ስምምነቶች እና ግንዛቤዎችም ይተካሉ።

18. የመገናኛ መረጃ

ስለእነዚህ ውሎች ማንኛቸውም ጥያቄዎች፣ ስጋቶች፣ ወይም ጥያቄዎች ካሉዎት እባክዎ በሚከተለው ያግኙን፦
